Furthermore, as a minor living far away, it was practically difficult for her to manage or dispose of real estate even if she acquired the shares. Choosing a method that provided actual, tangible benefits was more important than simply securing a deed.

3. Legal Strategy

Law Firm Theo responded to the co-heirs’ pressure for a waiver by clearly asserting the client’s legitimate inheritance rights. We emphasized the minor's limitations in property management, the high potential for future conflict over co-owned property, and the need to protect her actual interests. We successfully argued that a "value division (cash settlement)" was the most rational approach. We also ensured the "special benefits" issue was balanced fairly during the final calculation.

4. Result

An agreement was reached during mediation. Instead of taking ownership of the real estate, the client received her specific share of the inheritance in cash. This avoided a complex co-ownership situation and allowed the dispute to be settled quickly and effectively.
