Successful mediation of an assigned debt claim, achieving a major reduction in interest

1. Case Overview

The clients were in a situation where they inherited loan debts caused by a family member who had misused a parent's name. The period for Special Limited Acceptance had already expired, and they had lost the first trial because a statute of limitations defense was not raised. As a result, the clients were at risk of bearing the full amount of the debt and sought legal assistance for the appeal stage.

2. Unique Aspects of the Case 

This case had a very unfavorable structure for the following reasons:

  • The potential for full liability of the inherited debt due to the expiration of the Special Limited Acceptance period.

  • Loss of defense opportunities due to the omission of the statute of limitations defense in the first trial.

  • The creditor submitted evidence and claimed an interruption of the statute of limitations based on past payment orders. Due to these factors, it was an extremely difficult situation to overturn in the appeal.

3. Legal Strategy

Law Firm Theo determined that a strategic approach was more vital than a simple legal dispute. While actively asserting the statute of limitations defense, we focused on providing a thorough explanation of the clients' specific circumstances during the court’s mediation process. Specifically, we emphasized that it was inequitable for the clients to bear excessive responsibility—including interest—simply because of inheritance, especially when a third party actually caused the debt. We aimed to guide the case toward mediation to find a realistic solution.

4. Results A "decision in lieu of mediation" was finalized, achieving the following results:

  • Most of the interest, which constituted a large portion of the claim, was reduced.

  • The principal was also adjusted, significantly decreasing the clients' burden.

  • A realistic resolution was reached by allowing the clients to pay their respective portions in installments.

  • The opponent's litigation costs from the first trial, which the clients were originally slated to pay, were waived.\
