1. Case Overview

The debtor previously initiated individual rehabilitation at the Incheon District Court through Law Firm Theo and reached the commencement decision stage. However, due to an unexpected car accident, worsening symptoms of alcohol dependency, and subsequent job loss, they were unable to maintain the original case and had to withdraw it. Afterwards, the debtor regained their will to live, moved near their parents in Daejeon to dream of a comeback, and requested Law Firm Theo to handle their re-application.

2. Case Specifics

This was a 're-application' case with a history of prior filings. The key challenge was the perceived uncertainty of continuous income, as the debtor had been hospitalized in a closed psychiatric ward for bipolar disorder and alcoholism. Furthermore, the debt amount had increased since the previous application, leading us to expect a much stricter review by the court.

We appealed to the court regarding the debtor's strong will for rehabilitation and their desire to reflect on past wandering to support their family through a written statement. Additionally, we quickly applied for a stay order against debt seizures and collection orders from lenders to ensure the debtor could secure a stable income environment.

4. Outcome
The Daejeon District Court accepted our explanation and, on November 29, 2024, issued a commencement decision for the debtor’s individual rehabilitation. Ultimately, the rehabilitation plan was confirmed with an encouraging repayment rate of 30 percent. Through this, the debtor gained a precious opportunity to overcome past pain and design a new life as a healthy member of society.
